It’s been five days now since a Florida Sheriff appeared onstage, while in uniform and on duty, and violated U.S. Law (The Hatch Act) in publicly endorsing a political candidate.

Is he still on the job? Has he been properly suspended while under investigation? Inquiring minds, and people who aren’t un-American and abusers of their power want to know.

UPDATE: A teacher in Kansas City has was suspended this week due to violation of the Hatch Act, in this case being pro-Obama. BTW, I must have watched 30-40 HOURS of CNN/MSNBC/Fox this week, and I never heard this story mentioned once. So, again, when does Sheriff Scott get sent home?

    I remember watching this and thinking he ought to be kicked off the force. One thing is for certain: I would not want a hatemonger, paranoid, delusional Sheriff like that in my town, first off. Also, if he broke the law by doing this, his ass ought to be kicked to the curb.

    I’m fed up with the Republicans and their Police State bullshit. Something needs to be done about this guy.

    You dillweeds (see, we can be nicer on our side since I didn’t call you dickheads again) need to check out the Hatch Act here http://www.osc.gov/hatchact.htm

    It’s mostly for Federal Employees for which I am one. If you can click on the link, look at permitted activities under state Employees of which the Sheriff is. You guys want to piss and moan about everything that doesn’t go your friggin’ ways. Gezz you pussies need to get a set and let it roll of you some times instead of sounding like a bunch of newborns………..no, wait, you guy’s wouldn’t know that sound, you like aborting them instead of having them…….

    Read the site, it explains the Hatch act, that’s all I said. You guys are calling for the sheriffs head for doing something completely legal. He’s an elected official as is any sheriff or governor, either of which can publicly endorse anyone they wish. As for the other crap of turning it back you little subjects on me, anytime you want to talk about Iraq, feel free to e-mail me. My son has done two tours there, was medivac’d out the first time, so I have more to lose than most. You ever spend time in uniform? I didn’t think so………..

    Thanks for the link, Buff. (yeah, I know now). Unfortunately, you made the case AGAINST the sheriff:

    These federal and D.C. employees may not-

    use official authority or influence to interfere with an election
    solicit or discourage political activity of anyone with business before their agency
    solicit or receive political contributions (may be done in certain limited situations by federal labor or other employee organizations)
    be candidates for public office in partisan elections
    engage in political activity while:
    ON DUTY
    in a government office
    WEARING AN OFFICIAL UNIFORM
    using a government vehicle
    wear partisan political buttons on duty

    Mr. Scott’s office receives federal funds, therefore he falls into this employment category. What part of “may NOT…engage in political activity while…ON DUTY or IN UNIFORM do you not understand?

    Dude violated the law. Period. Soldiers know it. Sheriffs should. My guess is he did, and is such a pig that he didn’t care.

    If the language for the Hatch Act excludes federal funding, then this guy is indeed a local employee. However, that does not explain how the teacher got busted for the Hatch act. Either both are charged and dismissed or neither. Can’t have it both ways.

    Bung — Interesting. I’ve heard this one before, so let me say it loud and clear: having a son who served in Iraq is not a reason why A) why the war is justified; B) why we should keep fighting the war; or C) a merit badge granting you the title of “expert.”

    What it does do is give you a reason to feel strongly about the war. Feeling strongly about it does not make your opinion more valid.

    I know some people who’ve been there too, guy. We all do. But I’m not going to exploit those relationships by using them here. If you want to talk about Iraq, I’m game. But I’m not going to do it through email.

    It does not exclude federal funding. He is considered more than just a local/state employee. As an aside, the restrictions for those who receive federal funding (like the Sheriff in question) are even more strict than for state/local employees.

    As I read the Hatch Act, that teacher may not have broken the law at all, while it’s pretty clear that Mike Scott did.

    Sorry Fireball, ( I knew you knew it was me), but its the same deal as a Governor. Probably shouldn’t have done it in his uniform you are correct about that, but, he can still endorse all he wants and they can put his name up as sheriff so it makes no difference.

    As for you post, no, I’m not for the war, but I’m not a pussy either. We’re in way over our heads, so we either get the job done, or our country implodes, you decide. My kid could tell you things to make your head spin, I’ll just leave it at that. I’ve spent 27 years as support for the Navy/Marine Corps and now the Coast Guard, Obama is ideal for me because of his big government Ideas. Of course, I’m not an expert as you smuggly assert, but I know and see more than most. Come on down to Norfolk some time, it’s a small little Navy town for you mod westerners. I can introduce you to thousands that support it, and they all wear a uniform. Of course my father did, and his generation is what’s keeping you and the rest of the world from speaking German. I guess you would have been against fuckin’ with Hitler too huh Post?

    Sheriffs are STATE employees by the way, as Hatch is explained here:
    Permitted Activities

    Covered state and local employees may-

    run for public office in nonpartisan elections
    campaign for and hold office in political clubs and organizations
    actively campaign for candidates for public office in partisan and nonpartisan elections
    contribute money to political organizations and attend political fundraising functions

    There’s no doubt whether or not Scott is a state or federal employee, he’s allowed to activily campaign in a partisan election.

    He is NOT, however, allowed to do it while on duty, and while in uniform. And yes, as there are federal prisoners in his county, he receives federal funding, and therefore falls under BOTH state and federal employee guidelines.

    He should be suspended at the least, fired at the most. I vote for fired.

    Bung, that’s a fallacy know as a “false dilemma.” Leaving Iraq will not cause America to “implode.” Such an absolute, either-or choice basically removes all credibility from your argument. Sorry, that’s how it works among us educated folk. I’ve been to Norfolk, by the way. Walked around the docks and took pictures of a few ships, a few submarines, and then the Enterprise as it was leaving. That was back in ‘93 or ‘94. I guess us “Westerners” wouldn’t understand it.

Face it, if he’d have endorsed your muslim friend, you’d have had not problem with it. Besides, your saviour, Colin Powell receives a federal retirement(actually two) and the entire world has seen him in uniform, so that means he should be arrested or stripped of his pension for the endorsement………now, put your typical spin on it………..you still playing with the radio stations? Hockey teams? Come on man, the race board could use some livening up, come around sometime, at least there, the posters aren’t as lopsided on their thoughts…………..

    Hey BJ, quote the statute all you want, the only time a Sheriffs salary is federally supplied is during transportation of prisoners across state line, that hardly qualifies as a firing offense. As I was reading your posts, I got that feeling that you get as you’re watching someone make a complete fool out of themselves. You really need to get some counseling to learn how to let go of all of your hate.
